Subscription Terms of Service & Cohort Agreement

Welcome to Bhavya EduHub. By creating an account, initiating an institutional onboarding, or subscribing to our Unified School & Coaching SaaS ERP platform, you (the "Institution", "Subscriber", or "Customer") agree to comply with and be bound by the following comprehensive Terms of Service.

1. Scope of Service & License Grant

Bhavya Consultancy Services grants the subscribing institution a non-exclusive, non-transferable cloud license to access the Bhavya EduHub platform (including Web Administration Portal, Principal Controls, Teacher Dashboards, Fee Management, Transport GPS Fleet, and Mobile Apps) according to the selected subscription plan tier limits.

2. 2026 Founding Cohort & Lifetime Price Lock Terms

Institutions enrolled under the 2026 Founding School Cohort or 2026 Founding Coaching Cohort receive special grandfathered pricing privileges:

• Lifetime Price Lock: The discounted subscription rate agreed upon at the time of initial signup is locked and grandfathered against standard catalog price revisions for the lifetime of continuous, uninterrupted platform usage.
• Renewal Grace Period: A 15-day renewal grace period is provided upon subscription expiry during which the price-lock guarantee remains fully preserved.
• Free Digital Identity Suite: All eligible founding cohort plans include complimentary lifetime access to the Digital Identity & Smart Card Designer Suite.

3. 14-Day Money Back Guarantee

New subscribers are covered under our 14-Day Money Back Guarantee. If you are not satisfied with platform performance, you may cancel within the first 14 calendar days of your initial paid billing cycle for a full refund of subscription fees, processed within 5–7 business days to the original payment source.

4. Data Privacy, Ownership & Tenant Isolation

Your institutional records belong entirely to you:

• Absolute Data Ownership: The subscriber retains full and exclusive ownership of all student records, fee logs, attendance history, academic marks, and parent contact information.
• Row-Level Security & Isolation: All tenant databases are strictly isolated with multi-layered Row Level Security (RLS) and schema isolation preventing unauthorized cross-tenant data leakage.
• Data Export & Backup: Administrators can export complete school databases in standard formats (CSV/Excel/PDF) at any time from the Platform Control Center.

5. System SLA, Uptime & Maintenance

We maintain an industry-standard 99.9% Uptime Service Level Agreement (SLA):

• Routine platform upgrades and scheduled maintenance occur during off-peak hours (11:00 PM to 3:00 AM IST) with advance dashboard notice.
• Continuous automated database snapshot backups are performed daily and geo-replicated across high-availability cloud infrastructure.

6. Account Responsibility & Credential Security

The subscribing institution is responsible for maintaining administrative access credentials, allocating role permissions securely, and ensuring staff confidentiality.

7. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any legal proceedings or dispute claims shall be subject to the exclusive jurisdiction of the competent courts in Garhwa / Ranchi, Jharkhand, India.
